Tackling the Trade in Looted Cultural Property

Program Description:
ELIPS, in partnership with California Lawyers for the Arts, is delighted to host a panel discussion at LACMA's Brown Auditorium which will address the recent response of the US Congress to the looting of antiquities from Syria with the enactment of the Protect and Preserve International Cultural Property Act (2016) and the legacy of Nazi-looted art with the enactment of the Holocaust Expropriated Art Recovery Act (2016). In the light of these legislative developments, the panel will discuss what steps lawyers, law enforcement agencies and museums can take to address the trade in looted art and cultural property.

Our expert panel will include speakers Margot Stokol, Director, Legal Affairs, Hammer Museum, Los Angeles; Elizabeth Rivas, Special Agent, Federal Bureau of Investigations, Art and Antiquity Investigations; and Daniel McClean, international art lawyer, Partner, Cypress LLP (Los Angeles) and Counsel, Howard Kennedy (London). 

The program will conclude with a private tour of the exhibition: Sarah Charlesworth: Doubleworld at 7:30 p.m.

PROGRAM DESCRIPTION:

Museums possess, own, and use copyrighted materials and works of art in a variety of ways, such as display, exhibition catalogues, online collections, and promotional materials.

Museums also create and commission copyrighted materials and works of art. Advancements in digital technology and distribution channels through the internet are creating new challenges and opportunities for museums to publish images in reliance on fair use in a rapidly developing and uncertain legal environment.

Mr. Goldstein will discuss fair use issues facing museums in fulfilling their mission to build, study and interpret collections of works of art for public benefit. In that context, Mr. Goldstein will discuss today's efforts by museums to develop and promote guidelines for museums' use of copyrighted materials and art works.

In Lenz v. Universal Music, the Ninth Circuit ruled that the Fair Use of another’s copyrighted work is a right.  It’s a revolution in copyright law – or is it?

Two titans of copyright – Corynne McSherry of the Electronic Frontier Foundation and Ben Sheffner of the Motion Picture Association of America – make rare in-person appearances, square off, and get to the bottom of the debate raging over Fair Use.  McSherry won the Lenz case, and will defend it.  Sheffner sees it differently, and sets his views forth in no uncertain terms.  

Topics of discussion will include:

•    Lenz v. Universal Music:  The baby can go crazy -- has copyright law gone crazy, too?
•    Authors Guild v. Google:  Cert denied -- what are the implications?
•    Graham v. Prince:  The newest battleground – appropriation or piracy of Instagram portraits?
•    Rogers v. Koons:  Would those puppies be barking a different tune today?
•    Balsley v. Larry Flynt Publications:  Would the “Hot News Babes” still beat fair use after Lenz?
